Third International Comparative Law Forum

During three years the international scientific seminars «Comparative Law: Current State and Prospects for Development» have been held in Ukraine. From the beginning organizers of this forum pointed ambitious aims: to attract attention of lawyers from post-soviet countries to comparative law as the instrument of the cognition of national and foreign law, the determination of the common, special and unique in legal development, the transformation of the national legal systems.

From another side there were aims of corporative character: the rapprochement of comparative lawyers,  the self-perception of their special group interests and needs, forming the circle of intensive conversation and collaboration, raising the level of their skill; creation of conditions for organizational integration of research fellows, lecturers and practitioners, whose professional subject is comparative law, into national association; the assistance in overcoming the marginal status of comparative law research and teaching, rising and modernizing the area of comparative law studies, developing the universities curriculum, creation of specialized chairs in law faculties, institutionalization of comparative law as the graduation specialization for law students.

The subject and form of organization made the seminars the unique phenomenon in Ukraine and post-Soviet space. The concept of the international scientific seminars «Comparative Law: Current State and Prospects for Development» provides the combination of different forms of work as round tables, plenary and sectional sessions, open lectures and presentations. Every seminar became the brain storm, directed to dissemination of scholar and teaching experience, formulation and discussion the new ideas.

Within the framework of the seminars was held the constituent conference of the Ukrainian Association of Comparative Law, which is the first and only association in this sphere in Ukraine and one of two functioning on post-Soviet space.

In 2006 the organizers of seminars created the site “Comparative Law” (www.comparativelaw.org.ua) which is the only web recourse in this sphere in post-Soviet countries. Now it functions in three languages (Ukrainian, Russian and English) as site of the Ukrainian Association of Comparative Law.  It became the place to publish documents of the Association, programs of the seminars, announcements and press-releases, texts of reports and materials of discussions, photo-galleries, short materials about books and journals, presented on the seminars etc.

Texts of reports and materials of discussions of every seminar are published as separate editions.  Open lectures on the seminars are published in series of methodical editions “Academy of Comparative Law (13 editions are already published in Ukrainian and Russian). With the organization of the seminars also connected the publication the international scientific journal “Comparative Legal Studies” (articles in Ukrainian and Russian) and series of scientific editions “Encyclopedia of Comparative Law” (5 editions are already published in Ukrainian). Participants of the seminar received memorable certificates.

The Third international scientific seminar «Comparative Law: Current State and Prospects for Development» was held on 17 – 20 of April 2008 in Simferopol and Partenit (Crimea). The organizers of the seminar were: Volodymyr Koretskyi Institute of State and Law of National Academy of Sciences of Ukraine, Volodymyr Vernadskyi Tavrian National University, Kyiv Law University of National Academy of Sciences of Ukraine, Ukrainian Association of Comparative Law, international scientific journal “Comparative Legal Studies”,  being supported by Coordinator of OSCE programs in Ukraine, the international law firm CMS Reich-Rohrwig Hainz TOV and “Yurydychna Gazeta” (“Law Newspaper”).

There were 157 participants (71 have arrived) from Ukraine (Kyiv, Odesa, Kharkiv, Lviv, Simferopol, Donetsk, Ternopil, Lugansk, Sumy, Uzhgorod, Mykolaiv, Poltava, Khmelnytsky, Ivano-Frankivsk, Kerch, Mariupol, Irpin), Russia (Moscow, St. Petersburg, Yekaterinburg, Saratov, Novosibirsk, Kazan, Volgograd, Khabarovsk, Ivanovo, Arkhangelsk, Novokuznetsk, Tambov, Irkutsk, Severodvinsk, Taganrog, Murom), Germany (Berlin), Belarus (Grodno), Uzbekistan (Tashkent), Georgia (Tbilisi). There were 22 doctors of law, 75 PhD in law, 32 university lecturers and research fellows, 19 post-graduates, 8 practicing lawyers.

In the scope of the seminar 2008 were organized:

1. Five open lectures (master-classes) by known Ukrainian and Russian scholars – as part of the project “Academy of Comparative Law”: Yuriy Tikhomirov (Moscow) “Comparative Law and Integrant Role of International Law”, Olga Skakun (Kharkiv) “Legal System – of State, Society, Region, and World? (On Basic Categories of Comparative Law)”, Vitaliy Oksamytnyi (Moscow) “Legal Systems of the World: the Identification Problems”, Oleksandr Kostenko (Kyiv) “Social Naturalism as Methodological Principle of Comparative Law and Legal Globalistics”, Hashmatulla Behruz (Odessa) “Actualization of Comparative Law Studies in the Era of Globalization”. Also the lecture by Akmal Saidov (Tashkent) “Religion and International Law” was presented in printed form. All lectures were published before the beginning of the seminar as separate brochures.

2. Round-tables:

- Globalization and law. Internationalization and fragmentation in legal development. International law and comparative law.

- Religion and law. Canonical law and churches’ social doctrines place in the development of modern legal systems.

3. Sections:

- Theoretical and methodological issues of comparative law.

- Comparative-typological and comparative-historical approaches in branch legal studies.

By O. Krupchan (Olena Shupinska, Svitlana Zadorozhnya), “Legal-State Regularities: Introduction in Theory” (Yuriy Vetyutnev), “Constitutional State and Human Rights and Freedoms: Ukraine and European Experience” and “Constitutional Justice in Ukraine” (Taras Thymbalistyi), “Activities of UNESCO in the Sphere of Cultural Heritage Preservation: Legal Aspects” (Tetyana Katkova). During the seminar the book exhibition was organized.

Reports and materials of discussions of the Third international scientific seminar «Comparative Law: Current State and Prospects for Development» will be published as special edition so as will be assessable on the Ukrainian Association of Comparative Law web site (www.comparativelaw.org.ua).
